Our Terms & Conditions of undertaking business deals.
General Conditions for submission of offer.
1. We as the authorized business associate of the Seller / Manufacturer would be entertaining the business inquiries from the genuinely interested buyers and the offers would be submitted either by us or directly by the end seller. In either of the cases the offers submitted would be authentic and deals can be finalized accordingly.
2. All the deals / contracts would be finally signed between the Buyer and the Seller and we would be working as the witness ( Seller's Mandate ).
3. No inquiry will be entertained by us / the seller for submission of offer, unless the buyer provides the full contact details at the time of inquiry.
4. Buyers to provide full details of their requirement, including product specifications, quantity, quality, desired pack size, name of the discharge port (in case of CNF offer) etc. as applicable.
5. To prove the authenticity of the requirement and the seriousness of the buyer, at the time of inquiry, the buyer should provide their Target Price for each item. In that way the inquiry will be treated as genuine and best possible offer would be submitted at the earliest.
6. If any buyer ask for the Price List, then it would be considered as a “ Price Fishing Case” , since there can never be a fixed price list for such commodities for various reasons. So in such requests, the inquiry will be treated as Fake.
7. No free sample is given to any Buyer, before finalization of order and receipt of the LC.
Offer Terms .
In certain cases sellers do not quote on CNF / CIF basis and the offers are given only on FOB basis. So in such cases, the buyers may arrange their own shipping company or we / seller can assist in getting the right shipper to transport the goods from the loading port. The freight negotiations etc. can be done by the buyer and the freight charges etc. to be paid by the buyer directly to the shipping company.
In all other cases, the sellers would be offering the rates on CNF/CIF basis, if the buyer wants that.
Inspection of Goods
Normally the goods will be inspected by SGS or equivalent inspection agency, at the loading port, at the Seller’s expenses to certify about the quality, quantity etc. and such inspection certificate will be the part of the documents for encashing the LC by the Sellers .
Payment Terms.
The normal payment term of each and every Seller is : 100% Irrevocable, Transferable / Non-transferable, Confirmed, Sight DLC / ARDLC from any top 50 world bank only. No other term of Cash Payment , Differed Payment etc. would be entertained at all.
In case of Drinks & Beverages particularly, the Principal End Sellers do ask for some advance payment and balance against dispatch through LC or on arrival of goods at the destination port, but before handing over of original BL etc..
Offer Validity :
In case of Food and certain other commodities, the validity of the offers are very limited and not more than 7 to 10 days only, due to the market fluctuations and other conditions. So the Buyers must be ready to take their decisions well within the validity time, or else the offer may be void.
Special Conditions :
No special condition like submission of Proof Of Performance , BL copy / SGS copy etc. will be entertained by the seller, before signing the contract / SPA, as this sort of requests by the buyer, are not permissible even by the ICC.
